Acceptable Use Policy

1. PARTIES CONCERNED

a) This Acceptable Use Policy (the “Policy”) has been compiled to allow You to get a clear understanding of what We expect from Our Users (each referred to as “You” or “Your”) and what they may expect in turn from Us when they use Our Solution.

b) Where the words "We", "Us" or "Our" are used in this Policy, this refers to Orbit Technology AS, a limited liability company incorporated under the laws of Norway, bearing the Norwegian organization no. 924 790 547.

2. CONTENT CONTROL

a) Due to the sheer amount of Content being produced by Our Users, We do not and cannot review all Content posted to or created by Our Users accessing the Solution and We do not warrant that any such Content is reliable, accurate or complete.

b) By using the Solution, You acknowledge that

c) We do not inquire into the backgrounds of the Users, conduct criminal screenings or attempt to verify the statements of the Users.

d) We cannot and do not warrant that each User of the Solution is who he or she claims to be. Accordingly, You must exercise good judgement in dealing with other Users.

e) You acknowledge that there are risks involved in communicating online, including without limitation, unknowingly dealing with underage persons or persons acting under a false pretences or for a criminal purpose. You agree to take all necessary precautions when communicating with or meeting with other Users, especially if You decide to meet in person.

f) You acknowledge that by providing You with the ability to generate and view Content, We are merely acting as a passive conduit for such distribution and You expressly relieve Us from any and all liability arising from Your use of any such Content.

3. CONTENT CREATION

a) You are responsible for any data, material or other Content that You create, place, transmit or display while using the Solution, including any consequences of such Content. It is therefore imperative that You exercise caution, good sense and sound judgement in using the Solution.

b) You warrant that any information or other Content You post to or transmit through the Solution is not misleading and offered in good faith, and that You have the right to post or transmit such Content.

c) You may not upload, distribute, use, post, publish, send or otherwise transmit through the Solution any Content which is libellous, defamatory, harassing, discriminating, abusive, sexually explicit, profane, racially offensive, hateful, obscene, harmful, offensive, vulgar, intimidating, invasive of privacy or publicity rights, abusive, illegal, improper or otherwise objectionable or inappropriate of any kind, including any material that exploits children or is in breach of other rights, or which may otherwise give rise to liability or violate any law, or any other material that We in Our sole discretion does not wish posted or transmitted on the Solution.

d) You must not obtain or attempt to collect email addresses or other contact information of others without their prior consent or otherwise obtain any materials or information through any means not intentionally made publicly available or provided for through the Solution.

4. CONTENT EXPOSURE

a) Any Content that You have provided to Us will be publicly viewable on Your Account, irrespective of the location of the viewer.

b) We are not required to host, display, or distribute any of Your generated Content and We may refuse to accept or transmit such Content, and may also remove or delete all or any portion of the Content from Our Solution. You expressly relieve Us from any and all liability arising from Your use of any such Content.

c) We do not guarantee that any Content will be made available on the Solution. We reserve the right, but do not have any obligation to, (a) monitor, remove, edit or modify any Content, in Our sole discretion, at any time, without notice to You and for any reason or for no reason at all; (b) remove or block any Content, from the Orbit Network or (c) re-post to the Orbit Network any Content.

5. COMMUNITY GUIDELINES

a) You will not harass others by continuing to attempt to communicate with someone who has clearly asked Youto cease communications.

b) You may not use the Solution to solicit others to join or become members of any other commercial online service or other organisation, or otherwise engage in deceptive online marketing or exploit the Solution unless expressly permitted by Us.

c) You must not impersonate any individual or other entity or misrepresent Your identity, imply that any statements You make are endorsed by Us, upload Content which depicts, describes, identifies or alludes to any person other than Yourself, place information in Your profile that is false or misleading in any way or otherwise misrepresent Your affiliation with any other individual or other entity, while using the Solution.

d) You may not register or use any payment method with Your Account that is not Yours or You do not have authorisation to use.

e) You may not take any action that damages or adversely affects, or could damage or adversely affect, the performance or proper functioning of the Solution.

6. SECURITY

a) You must not attempt to log into or attempting to log into a server or Account that You are not authorised to access or otherwise try to gain unauthorised access to Our Solution, computer systems, materials, information or any services made available on the Solution by any means, the server on which Our Solutionis hosted or any server, computer or database connected to Our Solution, or attempt to probe, scan or test the vulnerability of any system or network or otherwise attempt to interfere with, circumvent, or gain unauthorised access to other computer systems through the Solution.

b) You may not create or spread spam, phish, pharm, pretext, spider, crawl or scrape in connection with Youruse of the Solution or otherwise.

c) You must not attack Our Solution via a denial-of-service attack or a distributed denial of service attack, or otherwise attempt to circumvent, reverse engineer, decrypt, or otherwise alter or interfere with the Solutionor any Content thereof or make unauthorised use thereof or use the Solution in any manner that could damage, disable, overburden, or impair the Solution or otherwise interfere with any other party's use and enjoyment of the Solution.

d) You must not misuse Our Solution by knowingly introducing viruses, Trojan horses, cryptos, malware, time bombs, cancelbots, corrupted files, worms and logic bombs or other material or computer programming routines or engines, or engage in conduct that could damage, disrupt or otherwise impair or interfere with the Solution’s functionality or its operation or otherwise interfere with other Users’ use and enjoyment of the Solution.

7. LAWS

a) You must not use the Solution in violation of any applicable law or other personal or legal rights.

b) You must not violate Our or any third party's intellectual property rights or other proprietary rights, including, but not limited to, uploading or otherwise make available files that contain images, software or other material protected by intellectual property laws, including without limitation copyright or trademark laws and rights of publicity and privacy, unless You own or control the rights thereto or have received all necessary authorisations to do the same.

c) You will not solicit or attempt to solicit any bank account or credit card details or confidential financial information from any User of the Solution, nor will You provide financial information to any person that You have communicated with or met via the Solution. We will not be liable for any loss (financial or otherwise) suffered by You as a result of this behaviour.

8. BREACH OF POLICY

a) You may not violate any of the prohibitions contained in this Policy, nor assist or permit any persons to do the same.

b) Breach of some of the prohibitions contained in this Policy may be tantamount to breach of applicable law. We will report any such breach to the relevant law enforcement authorities and fully cooperate with those authorities by disclosing Your identity to them where allowed and or mandated to do so.

c) In the event of a breach of this Policy or laws, rules or regulations governing the use of the Solution, We may block or remove communications or materials that We determine to be in violation of the Policy or reduce, suspend, or permanently terminate Your use of the Solution, which reduction, suspension or termination may be without prior notice.
